Details of Disappearance

Shay was last seen in Berthoud, Colorado on July 15, 2006. His father, Gil Dwayne Fitzgerald Smith, at first said Shay had fallen out of the boat he was driving on Carter Lake.

He later admitted that in fact, Shay had been in a "Super Screamer" inner tube style raft being towed behind the boat at between 20 and 30 miles per hour when he fell out. Neither of the two adults on the boat were watching; Shay's three-year-old brother had been put in charge of him. Shay's life jacket, which was too large for him, was found at the scene, with one of its buckles undone.

Gil subsequently pleaded guilty to child abuse resulting in death in his son's case. A photo of him is posted with this case summary. Shay's body has never been found.
